Cotchett, Pitre & McCarthy Announces a Proposed $250 Million Settlement in Apple AI False Advertising Case

Cotchett, Pitre & McCarthy, along with co-lead counsel Kaplan Fox and Clarkson, filed a motion today asking the District Court to preliminarily approve a $250,000,000 Settlement with Apple Inc. in a nationwide false advertising class action concerning “Apple Intelligence” on iPhones. Plaintiffs claim that Apple saturated the market with advertising presenting the iPhone 16, and certain models of the iPhone 15, as a breakthrough in artificial intelligence. According to the complaint, the centerpiece of this marketing campaign was a dramatically enhanced AI-powered Siri personal assistant that could integrate information across apps. As alleged, millions of consumers purchased iPhones based on these ads; however, Apple failed to deliver the promised features.

Under the proposed Settlement, U.S. consumers and businesses who purchased an eligible iPhone during the Class Period (June 10, 2024 to March 29, 2025), and submit a valid claim, will be entitled to a cash payment for each device. In agreeing to the Settlement, Apple does not admit to liability and denies having engaged in any wrongdoing.

U.S. District Court Judge Noël Wise will now consider whether the proposed Settlement is appropriate. If preliminary approval is granted, Notice of the Settlement will go out to all members of the nationwide Class.

If approved by the Court, the settlement will provide timely relief to consumers and companies nationwide for Apple’s alleged failure to deliver the AI enhanced Siri features as advertised.”

The case is Landsheft v. Apple Inc., 5:25-cv-02668-NW, in the U.S. District Court for the Northern District of California. The Motion for Preliminary Approval was filed on May 5, 2026.
