PA Supreme Court Narrows Anti-Referral Law’s Reach Over Pharmacy Bills

On June 16, 2026, the Pennsylvania Supreme Court ruled 5-2 in 700 Pharmacy v. Bureau of Workers’ Compensation Fee Review Hearing Office that the Workers’ Compensation Act’s Anti-Referral Provision applies only to eight specifically listed medical services, not to prescription drugs or pharmacy services. The decision reversed a Commonwealth Court ruling that had allowed an insurer to refuse payment because the prescribing physician held a financial interest in the pharmacy that filled the prescription.

Insurers had leaned on the anti-referral law as a payment shield. The Court just took that shield away.

What the Ruling Means for Injured Workers Filing Claims

For claimants, the ruling closes a loophole insurers have used to delay or deny prescription reimbursement. Under the decision:

  • Insurers cannot deny prescription payment solely because a treating physician has a financial stake in the dispensing pharmacy

  • The Anti-Referral Provision remains limited to eight named services: laboratory, physical therapy, rehabilitation, chiropractic, radiation oncology, psychometric, home infusion therapy, and diagnostic imaging

  • Injured workers with denied or disputed pharmacy bills may have new grounds to challenge those denials

This ruling removes an excuse insurers have used to delay medication injured workers need to recover.
